* Can Apple Sue? *
comments

BuyMusic.com is the first out of the gates with an iTunes music store clone. The layout is very similar to iTunes. The prices are similar. I just saw a TV ad that looked EXACTLY like the Apple iPod/iTunes ads except the people were using a Nomad Zen instead of an iPod to listen to their legally downloaded tunes. I mean, same white background, same people singing their favorite songs, same everything. I think Apple may be able to sue buy.com for their blatant creative plagarism. BuyMusic sucks because they don't have universal licensing...you need to keep track of which songs you've downloaded and how many times you've burned it, etc. It's absolutely lame...iTunes works because there are no such "technological ideosyncracies". You go to the iTunes store, you buy some music, you get it on your computer, and bam you're done. If you loose it oh well you loose it. I hope Apple adds a "redownload" feature in the future but I hope it's simple and universal. BuyMusic changes their download policies from track to track and it's impossible to keep track (no pun intended) of it all. My advice: Wait for iTunes XP...it'll be worth it.

HighDecibel:

Be interesting if Apple successfully sued them, despite Apple also plagarising "The Postal Service" music video.

Having said this, the BuyMusic site is only slightly like iTunes. Besides can you really sue them for having a layout, so overly used anyway?

http://www.101cd.com/ isn't dissimilar from itunes or BuyMusic.com.

There need to be some stricter guidelines for suing...its ridiculous.
